JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-05-2019 The petitioner has a grievance that his application for mutation, consequent upon partition in the family, is not being processed by the Circle Officer, Sadar, Darbhanga. A copy of the application, said to have been made before the Circle Officer seeking mutation, has been brought on record by way of Annexure-1 to this writ application, which is dated 06.03.2019. It is not apparent from Annexure-1 as to when the said application was received in the office of the Circle Officer. In any event, the said application does not appear to be in accordance with the provisions of the Bihar Land Mutation Act,

Patna High Court CWJC No.9770 of 2019(2) dt.16-05-2019 2/2 2011, and Bihar Land Mutation Rules, 2012. Chapter-II of the said Rules, prescribes detailed procedure for filing of mutation petition.

Considering the facts and circumstances, this application is disposed of with liberty to the petitioner to make appropriate application in accordance with the provisions of the Act and the Rules before the Circle Officer. If the same is done, it is needless to say that the same shall be disposed of within the time limit, as prescribed under the Act itself. This application stands disposed of.
