The petitioners apprehend their arrest in Mufasil P.S. case No. 66 of 2018 registered under Section 363, 366A, 34 of the IPC.

The informant, grand father of the victim, named the petitioners and others and alleged that they kidnapped his minor grand daughter for the purpose of marriage or killing her. The learned counsel for the petitioners submits that the victim made her statement u/s 164 of the Cr. P. C. and she disclosed that she voluntarily left her house on 31.01.2018 and

Patna High Court CR. MISC. No.28428 of 2019(2) dt.30-04-2019 2/2 went along with Laxami Das @ Niraj Das @ Niraj Kumar, petitioner No.2, and solemnized marriage with him. The victim disclosed her age to be 19 years.

Considering the facts that victim herself denied the factum of her kidnapping and she disclosed that she voluntarily left her house and solemnized marriage with Laxami Das @ Niraj Das @ Niraj Kumar, petitioner No.2, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Mufasil P.S. case No. 66 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
