Mr.Anant Kumar 1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 06-08-2025 Heard Mr.Bindeswari Singh, learned counsel for the petitioner and the State.
2. The petitioner is in judicial custody in connection with Akornigola P.S. Case No. 144 of 2024 for the offence punishable under Sections 395 of the Indian Penal Code lodged on 20.06.2024 by the informant, Arun Kumar.
3. As per the prosecution story, the informant alleged that while he was on the road to catch train for Dehri, an Auto came, asked for the way to Dehri and later, on the point of pistol, snatched the mobile phone, this led to the FIR.
4. Subsequently, the investigation took the case to the doors of the petitioner who also has four criminal antecedents. As a result, he is in custody since 17.10.2024.
5. Learned counsel for the petitioner submits that in
Patna High Court CR. MISC. No.30446 of 2025(3) dt.06-08-2025 2/3 the confessional statement of Rahul Kumar, his name has come alongwith other accused persons which led to his implication. The said Rahul Kumar has been extended relief in Cr. Misc. No. 6441 of 2025 by a coordinate bench.
6. Let the same be kept on record.
7. Learned APP opposes the prayer though concedes that the similar situate Rahul Kumar has been extended relief.

Taking into account the aforesaid facts as also the undertaking of the petitioner that he shall be diligently appearing in trial, he is in custody since 17.10.2024, one of the co-accused Rahul Kumar has been extended bail, in that background, this Court is inclined to extend him the privilege of bail with conditions.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional District and Sessions Judge-XIX, Rohtas at Sasaram, in connection with Akornigola P.S. Case No. 144 of 2024 subject to the following conditions:
(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his bona fide;
Patna High Court CR. MISC. No.30446 of 2025(3) dt.06-08-2025 3/3 (ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Ravi/- U T
