The petitioners seek Anticipatory bail in connection with Daraunda P.S. Case No. 147 of 2017 registered under Sections 304(B), 201, 120(B) of the Indian Penal Code. Informant is the father of the deceased who has stated in his FIR that marriage of his daughter was solemnized with petitioner No. 1 on 25.04.2016 and they used to torture his daughter for non-fulfillment of demand of dowry. It has been further stated that his son-in-law had gone abroad for earning and petitioner Nos. 1, 2 and 3 were involved in this conspiracy. It has been further stated in FIR that on 29.07.2017 they killed
Patna High Court Cr.Misc. No.59244 of 2017(4) dt.20-02-2018 2/2 his daughter and also cremated her.
Learned counsel for the petitioners submitted that daughter of the informant died on 29.07.2017 and FIR has been registered on 04.08.2017 and petitioner Nos. 3 was not present at the time of occurrence and petitioner No.2 was loath and incapable to perform her daily routine. It has been further submitted that the family members of deceased were present at the time of funeral and subsequently this FIR has been lodged.
Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioners named above in the event of arrest or surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Daraunda P.S. Case No. 147 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
