The petitioner is apprehending his arrest in connection with Complaint Case No.915 of 2015 , registered for offences punishable under Sections 420, 323, and 504 of the Indian Penal Code.

Allegation against the petitioner is that he has taken Rs.15 lac for the purchase of land on the interest of Rs.04 per hundred and assured to return the amount in 1 1⁄2 months. Submission of the learned counsel for the petitioner is that the matter is in the nature of civil and the money suit has already been filed by the complainant.

Patna High Court CR. MISC. No.26990 of 2019(2) dt.25-04-2019 2/2 Heard learned A.P.P. and the learned counsel for the complainant. They have opposed the prayer for bail on the ground that the petitioner has taken money for purchasing the land and he has not returned the same. .

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-V, Sasaram, District Rohtas in connection with Complaint Case No.915 of 2015, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
