JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-09-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 323, 307 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, this petitioner is alleged to have caused injury to the informant by firing. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. In fact, the informant met with an accident as a result of which he sustained injury. Petitioner is in custody since 26.02.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail and submits that there is direct and specific allegation against this petitioner of firing and causing injury to

This petitioner has got criminal antecedent and he is accused in five other criminal cases. Considering the facts of the case and the nature of accusation against this petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
