JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-05-2018 In order no.4, dated 27.03.2018, due to inadvertence instead of para 6 and 7 of the counter affidavit of the University, para 6 and 7 of the counter affidavit of State has been quoted. Let the same be deemed to be deleted and in place thereof, the same be read as follows:

"6. That it is respectfully stated and submitted that the University has decided to confirm the petitioner as an Assistant Professor in accordance with law in the forthcoming meeting of the Confirmation Committee, which is likely to be held in the next month i.e. March 2018. It is further stated and submitted that the promotion of the petitioner under Career Advancement Scheme will be taken up later on.

7. That from the averments made above it is clear that since the university is going to confirm the petitioner as an Assistant Professor in accordance with law in the forthcoming meeting of the Confirmation Committee, which

Patna High Court CWJC No.702 of 2016 (5) dt.08-05-2018 2/2 is likely to be held in the next month i.e. March 2018 the writ petition has now become infructuous and the same is fit to be dismissed at the stage of admission itself."

The order dated 27.03.2018 is modified to the extent indicated hereinabove.
