The petitioner apprehends his arrest in Forbesganj P.S. Case No.422 of 2017 registered under Sections 147, 149, 341, 323, 324, 307, 354(B), 427, 379, 504, 506 of the Indian Penal Code.

The informant alleged that While she was cleaning her tea stall, the petitioner and others came and assaulted the informant. When her husband came, the petitioner is alleged to have assaulted her husband. The accused persons assaulted all the family members of the informant.

The learned counsel for the petitioner submits that the father of the petitioner and husband of the informant are full brother. The tea stall of the informant and father of the petitioner

Patna High Court Cr.Misc. No.34595 of 2018 (2) dt.02-07-2018 are situated side by side. On account of some land dispute, both sides entered into mutual assault. From the side of the petitioner, Forbesganj P.S. Case No.424 of 2017 is registered against the informant and others. The injury found on the husband of the informant is simple in nature.

Taking into consideration the fact that both sides who are close relatives entered into a scuffle on account of land dispute, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No.422 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
