In this case, the petitioners are seeking anticipatory bail in connection with Bath (Bhagalpur) P.S. Case No.118 of 2017, registered for the offence punishable under Sections 147, 149, 323, 307, 337 and 379 of the Indian Penal Code.
Patna High Court Cr.Misc. No.36970 of 2018(2) dt.02-07-2018 2/3 As per the F.I.R. the informant has been informed that the villages wanted to kill him. Allegation has been made that while the informant was going on his motorcycle, he was knocked down from the motorcycle and also assaulted. Whereupon, the informant resorting firing and went to the Police Station.
It appears that the informant himself resorted firing from his licencee gun. There is case and counter case from both the sides.
Looking to the aforesaid facts and circumstances of the case, let the above named petitioners, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Bath (Bhagalpur) P.S. Case no.118 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioners for the purposes of investigation and interrogation, they will remain present for the investigation.
