2. In the present case, the petitioners are apprehending their arrest in connection with Barachatti P.S. Case No. 370 of 2021 registered under Sections 304(B) & 120(B) of the Indian Penal Code.

3. As per prosecution case, the married daughter of the informant was found dead in her paternal home and her husband fled away from the spot. The petitioners are the sister and brother-in-law of the husband of the deceased and allegation against them is that they used to pick quarrel and assault the deceased after her marriage. Further allegation is that the son-inlaw of the informant committed murder of his wife in

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. The petitioners are the married sister and brother-in-law of the husband of the deceased and they have no role in the whole occurrence. From the FIR, it is also clear that the daughter of the informant died in his own house and there was no demand of dowry. The allegation is completely vague and not believable. The co-accused husband has been granted bail by a Coordinate Bench of this Court vide order dated 17.12.2025 passed in Cr. Misc. No.70438 of 2025. The petitioners are having clean antecedents.

5. Learned APP vehemently opposes the submission made on behalf of the petitioners.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the completely vague nature of allegation against the petitioners and further considering the strong possibility of false implication and also considering the clean antecedents of the petitioners, let the petitioners above named, in the event of their arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds

Patna High Court CR. MISC. No.28767 of 2026(2) dt.05-05-2026 3/3 of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Sherghati, Gaya, in connection with Barachatti P.S. Case No. 370 of 2021, subject to the condition as laid down under Section 482(2) of the BNSS, 2023 and other following conditions:

(i) One of the bailors will be a close relative of the petitioners.

(ii) The petitioners will remain present on each and every date fixed by the below, if so required by the learned trial court.
