The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code. The prosecution case is that the informant being owner of an Orchestra party was forced to perform till early morning by the petitioner and on refusal to perform he was assaulted by the petitioner and others as a result he sustained injury.

It is submitted by learned counsel for the petitioner that only one lacerated wound on the base of the nose of the informant was found which does not suggest that any

Patna High Court Cr.Misc. No.60533 of 2017 (2) dt.13-12-2017 2/2 assault was made. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Considering the accusation being not corroborated with the medical opinion coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Gopalganj in connection with Mahammadpur P.S. Case No. 91 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
