2. The petitioners seek bail in connection with S. Kamal P.S. Case No. 166/2024 registered for the offences under Sections 392, 307, 326 of I.P.C. and Section 27 of Arms Act.
3. As per the prosecution case, the informant has
2/4 alleged that some unknown miscreants took away gold worth Rs. 10,00,000/- along with some cash of the informant.

Learned counsel for the petitioners submits that petitioners are not named in the FIR and their names have surfaced in the confessional statement of co-accused Vicky Mishra @ Sunil Kumar Mishra who was arrested in another case being Bakhari P.S. Case No. 302/2024. Learned counsel further submits that no incriminating article has been recovered from the conscious possession of the petitioners. Learned counsel further submits that till date no TIP has been conducted in order to identify the criminals involved in the present case. Learned counsel next submits that similarly situated co-accused namely Piyush Kumar has been granted bail by this Court vide order dated 07.05.2025 passed in Cr. Misc. No. 16254 of 2025. It is lastly submitted that each of the petitioners carry four criminal antecedents and they are in custody since 12.11.2024.
5. Learned APP for the State has opposed the prayer for bail of the petitioners and submits that the petitioners carry criminal antecedent of similar nature and hence, they should not be granted privilege of bail.
6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody of the
3/4 petitioners and the fact that no incriminating article has been recovered from their conscious possession, let the petitioners above-named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) on each of them with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Begusarai in connection with S. Kamal P.S. Case No. 166/2024 subject to the conditions :- a. One of the bailors of the petitioners shall be their close relative.
b. The petitioners shall remain physically present in Court on each date of the trial.
c. In case of absence on two consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to the cancelled by the court concerned.
d. The Court below shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioners. However, the
4/4 acceptance of bail bonds in terms of the aforementioned order shall not be delayed for purpose of or in the name of verification.
