JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 10-11-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 414/34 of the Indian Penal Code and Sections 25(1-B)a/26/27/35 of the Arms Act.

The accusation is that during an orchestra programme the petitioner and others fired in the air. It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that the petitioner resorted to firing or firing made by him caused injury to anyone rather it is an admitted position that the petitioner

Patna High Court Cr.Misc. No.51912 of 2017 (2) dt.10-11-2017 2/2 received firearm injury resorted to by some other person. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the fact that there is nothing on record to suggest that firing made by the petitioner caused injury to anyone and petitioner having no criminal antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Sikrahana at Dhaka, East Champaran in connection with Chiraiya (Shikarganj) P.S. Case No. 09 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
