2. The petitioner seeks bail in connection with Samastipur Mahila P.S. Case No. 41 of 2023 registered for the offence under Sections 376D/341 of the Indian Penal Code and under Section 4 of the POCSO Act.
3. As per the prosecution case, the petitioner and other accused persons are said to have committed rape upon victim.
4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has not committed any offence as alleged by the prosecution side.
5. He further submits that the medical examination
Patna High Court CR. MISC. No.33144 of 2024(2) dt.21-06-2024 2/2 of the victim was conducted by the medical board but no injury has been found and there is no sign of rape being committed.
6. Learned counsel for the petitioner also submits that the petitioner is in custody since 17.2.2024.
7. Considering the aforesaid facts, this application is allowed.
8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-VI-cumSpecial Judge, POCSO, Samastipur/concerned Court below in connection with Samastipur Mahila P.S. Case No. 41 of 2023(S) and G.R. No. 25/2024.
