JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2017 This is an application for grant of anticipatory bail for offences punishable under Section 379 of the Indian Penal Code and 135/138 of the Electricity Act.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that accusation against the petitioner is an afterthought case. As a matter of fact, in place of the name of other accused after interpolation the name of the petitioner was inserted. It is alleged that he was committing power theft for running his flour mill. But as a matter of fact he is a Government servant and has no flour mill.
Heard learned counsel for the S.B.P.C.L. He also could not controvert.

No.48836 of 2016 (3) dt.17-01-2017 2/2 Having heard both sides, in view of the fact stated above, let above named petitioner, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate II, Sheikhpura in connection with Barbigha P.S. Case no. 275 of 2012 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure on conditions that he will cooperate in the investigation and will appear before the police as and when required.
