JUSTICE ARUN KUMAR ORAL ORDER 09-11-2017 Heard learned counsels for the petitioner and the State as well as learned counsel for the informant. The petitioner apprehends his arrest in connection with Makhdumpur P. S. Case No. 50 of 2017 instituted under Sections 147, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that on trivial issue on account of falling water in the house of the other side, scuffle took place and there is case and counter case between both sides and the allegation against the petitioner is that he gave an iron rod blow over the head of the informant's mother but no such corresponding injury was found and only abrasion was found on the upper arm and the petitioner has got no criminal antecedent. Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.53039 of 2017 (2) dt.09-11-2017 2/2 circumstances, let the petitioner, namely, Raj Nandan Yadav, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S.Case No.50 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
