2. The petitioner is apprehending his arrest in connection with Sadar, Muzaffarpur P.S. Case No. 741 of 2024 for the offence under Sections 80, 103(1) and 3(5) of the BNS.
3. As per the prosecution's case, the informant alleged that he married his daughter, Juhi Kumari, to Chandan Kumar (petitioner) on 11.12.2020, in accordance with Hindu rites and rituals. Initially, the couple's married life was running smoothly. However, after some time, the behaviour of her in-laws changed, and they began to mentally harass her by demanding additional dowry of Rs. 5,00,000/-. Despite his financial
Patna High Court CR. MISC. No.35475 of 2025(3) dt.20-08-2025 2/3 limitations, the informant managed to pay Rs. 1,50,000/- in 2023. On 02.11.2024, at around 10:00 AM, the informant received information that his daughter had died by committing suicide. Upon reaching her matrimonial home, he found her body lying on the bed and suspected that she had been murdered, as there were visible marks on her neck and blood was oozing out from her teeth gums.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and he has falsely been implicated in the instant case. From bare perusal of F.I.R. itself, it is admitted that father of the petitioner communicated to the father of the victim regarding the suicide committed by her daughter. There is general and omnibus allegation in the F.I.R. against the petitioner with only motive to falsely implicate him. Learned counsel further submits that after the marriage, it came to knowledge that the deceased was suffering from psychological problem of 'Schizophrenia'. It is informed by the informant's family that it will be cured by passage of time. Petitioner and his parents continued with the treatment of deceased and then treatment was also made in AIIMS Patna.
5. Learned APP vehemently opposes the prayer for

6. As per the allegation, the petitioner is the husband of the deceased and he has full responsibility to keep and maintain her wife with full honour and dignity. From perusal of F.I.R. it appears that the wife of the petitioner (deceased) was killed on the alleged date and time of occurrence. In case diary, the witnesses have also supported the allegations of torture and harassment leveled against the petitioner and his family members. Investigation is still going on.
7. In these circumstances, I am not persuaded to grant the privilege of anticipatory bail to the petitioner. Accordingly, the prayer of anticipatory bail of the petitioner stands rejected. (S. B. Pd. Singh, J) Ankit Kumar/- U T
