This application is for grant of regular bail in connection with Bairagania P.S.Case No.286 of 2018 for the offences under Sections 363, 366A, 376, 302, 120B and 34 of the Indian Penal Code and Sections 4, 6,8 and 12 of the POCSO Act..

Minor daughter of the informant was traceless and later on her dead body was found with injury on her private part and there was suspicion against the petitioner who used to talk with the deceased.

Submission of the learned counsel for the petitioner is that except the suspicion there is nothing against him whereas the prayer for bail has been opposed by the learned APP on the ground that there was injury over the dead body and

Patna High Court CR. MISC. No.29645 of 2019(5) dt.03-02-2020 2/2 there is suspicion against petitioner and the CDR also shows that the petitioner was in talking term with the deceased prior to the occurrence.

Heard learned A.P.P. also.

Having heard both sides and considering the submissions as made above, I am not inclined to grant bail to the petitioner, however, since he is in custody for more than one years, the learned trial court is directed to expedite the trial . With the aforesaid observation, this application is dismissed.
