This application for anticipatory bail arises out of Nawada (Town) Police Station Case No. 736 of 2018 for the offence punishable under Sections 420/467/468/471/34 of the Indian Penal Code and Section 138 of the N.I. Act. The petitioner contends that he is brother-in-law of the co-accused, Mohnish Kumar, who is said to have issued a cheque worth Rs. 37,50,000/- (Thirty Seven Lacs Fifty Thousand only), which stood dishonored. Though he has been described as the manager of Rajani Enterprises, owned by coaccused, Mohnish Kumar, it is specific case of the petitioner that he has no connection at all with the said company/said enterprises.

Patna High Court CR. MISC. No.27468 of 2019(2) dt.26-04-2019 2/2 It is alleged in the First Information Report that on an assurance given by the petitioner also, the informant had given a loan worth Rs. 1,50,00,000/- (One Crore Fifty Lacs) to co-accused, Mohnish Kumar.

Considering the facts and circumstances, as noted above, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Nawada (Town) Police Station Case No. 736 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
