JUSTICE ANIL KUMAR SINHA ORAL ORDER 08-01-2021 Heard Mr. Arvind Kumar Mouar, learned counsel for the petitioner and Mr. Mithlesh Kumar Khare, learned Additional Public Prosecutor appearing for the State. Petitioner seeks regular bail in connection with Sessions Trial No. 618 of 2019 arising out of Harnaut (Kalyan Bigha) P.S. Case No. 319 of 2019 registered for the offences punishable under Sections 302, 201, 120(B) and 34 of the Indian Penal Code, 1860.
The allegation as per the First Information Report is that the petitioner along with other co-accused persons has killed Indrawati Devi @ Indra , wife of co-accused Nandu Tanti, after pressing her neck.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of
Patna High Court CR. MISC. No.28526 of 2020(4) dt.08-01-2021 2/3 suspicion only. Learned counsel further submits that during course of investigation, the confessional statement of coaccused Nandu Tanti has been recorded and he has accepted his guilt that he has killed his wife Indra Devi (since deceased) due to his having illicit relationship with another co-accused Shanti Devi. Learned counsel referring to the confessional statement of co-accused Nandu Tanti submits that even in the confessional statement of the co-accused, no role has been attributed to the petitioner and co-accused Nandu Tanti has merely said that the petitioner was having knowledge about the illicit relationship of Nandu Tanti with the co-accused Shanti Devi. Learned counsel also submits that the petitioner is in custody since 4.11.2019.
Having regard to the submissions made by the parties and taking into consideration the materials on record, the fact that petitioner is in custody since 4.11.2019 and charge sheet has already been submitted as well as there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
