The petitioner seeks bail in connection with Manuyari P.S. Case No. 268 of 2019 registered under Sections 302/34 of the Indian Penal Code besides Section 27 of the Arms Act, pending in the court of the Additional Sessions Judge, Muzaffarpur.
Earlier, the prayer of the petitioner for grant of bail was rejected by this Court vide order dated 02.03.2020 passed in Criminal Misc. No.10162 of 2020 on merit, taking into consideration that the petitioner was the sole person, who was making firing in an orchestra programme, in which Abhishek Kumar, the son of the informant Raghunath Sahni, who was
Patna High Court CR. MISC. No.28582 of 2020(3) dt.03-02-2021 2/2 entertaining the orchestra party, sustained firearm injury and died.
Learned Senior counsel appearing on behalf of the petitioner submits that the petitioner is in custody since 18.10.2019.
Having regard to the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to reconsider the prayer of the petitioner for grant of bail. Accordingly, the prayer of the petitioner for grant of bail stands rejected for the present.
