The petitioners apprehend their arrest in Manihari P.S. Case No. 90/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The informant filed a complaint case no. 529/2014 on the basis of which the present F.I.R. was lodged. The informant alleged that on 23.01.2014 all the accused persons came to his house and asked the informant to withdraw the case, on refusal the accused persons having armed with different weapons came and assaulted the informant and others.
It is submitted that of course, the occurrence took place on 23.01.2014, but the complaint petition was filed on 06.03.2014
Patna High Court Cr.Misc. No.45701 of 2016 (3) dt.20-12-2016 2/2 i.e., after one and half month. The informant got simple injury. There is land dispute from before.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Manihari .S. Case No. 90/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
