JUSTICE SANJAY PRIYA ORAL ORDER 17-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Section 409 of the Indian Penal Code.

It is alleged in the written report that in spite of direction of the authority the petitioner being the Panchayat Secretary did not provide the merit list of selected teachers during the period 2006 to 2015.

It has been submitted by the petitioner that he has joined the post in the year 2012 and he has not been handed over the required documents. He specifically stated in paragraph-5 of the bail petition that whatever the document he got from his predecessor, has been submitted to the authority.

No.1169 of 2017 (2) dt.17-01-2017 2/2 In support of the aforesaid statement, the petitioner has drawn attention to this Court vide Annexure-2 at page-18 of the bail petition which shows that he has sent the merit list by registered post vide letter dated 14.9.2016. It has further been submitted that the co-accused persons with similar allegations have been granted anticipatory bail by a co-ordinate Bench of this Court vide orders dated 19.12.2016 and 22.12.2016 passed in Cr. Misc. 49613 of 2016 and 53838 of 2016 respectively. Considering the aforesaid facts and circumstances of the case, let the petitioner in the event of surrender, named above, within six weeks from the date of receipt of this order, in connection with Dandari P.S. Case No. 41 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Begusarai, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
