The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 420, 467, 468 and 471 of the Indian Penal Code and Section 135 of the Negotiable Instrument Act.
Allegation has been made that petitioner has taken Rs.8.50,000/- from the informant with the assurance that he will made the Chairman of the institution. Accordingly informant has collected the money and handed over the same to the petitioner but neither he was made the Chairman nor any dividend has been given. He has only returned Rs. 2,00,000/- but the rest amount has not been handed over to the petitioner.
Patna High Court Cr.Misc. No.37045 of 2018 (2) dt.03-07-2018 Learned counsel for the petitioner submits that petitioner is secretary and he is also a member of the NGO and he has been removed from the Executive Committee and that is the reason to lodge the present case.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner, namely, Shailendra Kumar @ Bipin Kumar, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Patna in connection with Bahadurpur P.S. Case No.18 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) Vinay/- U T
