This application, for grant of regular bail, arises out of Kotwa Police Station Case No. 24 of 2021, disclosing offences under Section 414 of the IPC The allegation, as per the First Information Report is that the stolen motorcycle has been recovered from the Courtyard of the house of the petitioner.
Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. Learned counsel next submits that the alleged motorcycle was not recovered from the house of the petitioner rather it was parked outside the house. Moreover, no theft case has been registered regarding those motorcycle. Learned counsel further submits that petitioner is in
Patna High Court CR. MISC. No.38786 of 2021(2) dt.13-12-2021 2/2 custody since 22.02.2021.
Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that petitioner is in custody since 22.02.2021 having no criminal antecedent, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 10th Additional Chief Judicial Magistrate, East Champaran at Motihari, in connection with Kotwa Police Station Case No. 24 of 2021.
