The petitioners are apprehending their arrest in connection with Bajapatti P.S. Case No. 206 of 2015 registered for the offences punishable under Sections 498A, 354/34, 379, 354B, 307/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.
It has been submitted on behalf of the petitioners that petitioner No.1 is father-in-law and petitioner No.2 is mother-inlaw of the informant and there is omnibus allegation against both the petitioners and the husband of the victim has already been granted regular bail by the court below itself. Heard learned APP also.
Having heard both sides and considering the aforesaid
Patna High Court Cr.Misc. No.995 of 2017 (3) dt.08-02-2017 2/2 facts, let the petitioners, named above, in the event of their arrest or surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Pupari at Sitamarhi, in connection with Bajapatti P.S.Case No. 206 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the further conditions that one of the bailors should be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further the petitioners shall co-operate in the trial and make themselves available before the court as and when required and in the event of failure on their part to appear before the court on two consecutive dates, without showing any genuine reason, their bail bonds shall be liable to be cancelled.
