JUSTICE ARUN KUMAR ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Muffasil P.S. Case No.138 of 2017, registered under Sections 341, 323, 308 and 504 of the Indian Penal Code. Allegation is that on some petty issue, the petitioner objected grazing of she-buffalo by the informant in front of his agricultural field and assaulted the informant with lathi. Learned counsel for the petitioner submits that no injury was caused to the informant. There is no any document regarding treatment of the informant in the hospital and this case was lodged after two days of the occurrence, this petitioner has got no criminal antecedent.

No.52872 of 2017 (2) dt.09-11-2017 2 /2 Having considered the said facts and circumstances, let petitioner, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Muffasil P.S. Case No.138 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
