The petitioner is apprehending her arrest in a case registered under Sections 354/34 of the Indian Penal Code and Section 8 of the POCSO Act.
The prosecution case, in brief, is that on the alleged date and time of occurrence when the informant was going outside her house for some work, in the meantime the petitioner called the informant into her house. Thereafter accused Shambhu Kumar and Vikash Kumar forcibly pushed the informant and tried to chase her modesty. Upon which she started making hulla several villagers assembled there, then the accused persons including the petitioner managed to escape.
Patna High Court Cr.Misc. No.52276 of 2016 (2) dt.07-12-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is a lady. No specific allegation has been made against her. The main allegation has been made against the co-accused, namely, Vikash Kumar and Shambhu Kumar.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st-cum-Special Judge (POCSO Act), Gaya in connection with Mahila P.S. case No.05 of 2016/ POCSO case No.6 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
