JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Turkaulia (Banjariya) P.S. Case No. 137 of 2017, registered under Sections 406 and 420 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The accusation is that complainant/informant settled the marriage of his daughter with the petitioner, Hari Shankar Choudhary, son of Biltu Choudhary, and also gave cash of Rs.2,02,100/- as gift at the time of 'Cheka". When the complainant-informant approached for fixing the date of marriage then father and brother of the petitioner, namely, Biltu Chaudhary

Patna High Court Cr.Misc. No.54862 of 2017 (2) dt.20-11-2017 and Ram Pravesh Chaudhary, made demand of cash of Rs.10,00,000/- more and a Alto car, as petitioner has been selected in the Railway Department. Thereafter, complainant-opposite party no. 2 also approached the petitioner then he also repeated same demand.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to ulterior motive.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, in connection with Turkaulia (Banjariya) P.S. Case No. 137 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
