The petitioners seek anticipatory bail in a case instituted for the offences under Sections 147, 148, 149, 342, 323, 325, 307, 353, 386, 387, 427 and 504 of the Indian Penal Code. It has been alleged that the police party has gone to the village to arrest three accused persons, namely, Ravindra Yadav, Mahendra Yadav and Satendra Yadav and they were arrested. When the police party were returning the people of locality has created obstacle in taking away the accused persons, they have pelted stones and also assault was inflicted upon the police party including they have tried to snatch away the rifle.

Patna High Court Cr.Misc. No.37303 of 2018 (2) dt.04-07-2018 2 /2 Learned counsel for the petitioner submits that in the body of the First Information Report no specific allegation has been attributed against the petitioners.

Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Subodh Kumar @ Subodha and Sukhendra Yadav @ Buttu, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Paraiya P.S. Case No.187 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
