The petitioner seeks bail in Siwan (Thawey) Rails P.S. Case No. 42 of 2018, instituted for the offence under Section(s) 25(1-B)a, 26 and 35 of Arms Act.

Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 11.10.2018 passed in Cr. Misc. 59472 of 2018.

It is alleged in the written report that one firearm has been recovered from possession of the petitioner. Report was called for from the court below which has been received. From the report it appears that charge has been framed in this case on 8.2.2019. The case is pending for evidence. The court below has mentioned in the report that two

Counsel for the petitioner submits that co-accused Sonu Chauhan with similar allegation has already been granted bail by this Court vide order dated 10.4.2019 passed in Cr. Misc. 10870 of 2019.

Petitioner is in custody since 20.3.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Siwan (Thawey) Rails P.S. Case No. 42 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
