The petitioner apprehends his arrest in Tekari (Panchanpur O.P.) P.S. Case No.273 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act. The police apprehended one Anand Kumar Singh @ Buku Kumar and from his possession three bottles of Royal Stage Wisky were recovered. Anand Kumar Singh @ Buku Kumar disclosed that the petitioner had given liquor to him. Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner. Anand Kumar Singh @ Buku Kumar is co-villager of the petitioner and on account of village politics the petitioner has falsely been implicated in this case.
Having considered the fact that the name of petitioner
Patna High Court CR. MISC. No.27941 of 2019(2) dt.29-04-2019 2/2 was disclosed by the person from whose possession small quantity of liquor was recovered but nothing has been recovered from possession of the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya in connection with Tekari (Panchanpur O.P.) P.S. Case No.273 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
