The petitioners apprehend their arrest in a case registered for the offences punishable under Section 504, 323, 354, 379, 307, 147 and 506 of the Indian Penal Code. Over a petty dispute petitioner Jay Prakash Kumar is said to have shoved the informant on the ground holding her hair while petitioner Shiv Raj Singh gave rod blow on her head inflicting injury to her.

Learned counsel for the petitioners submitted that no such occurrence as alleged ever took place. The petitioners are quite innocent and have been falsely implicated in this case due to petty dispute. There is a land dispute between both the parties. The injury sustained by the informant is simple in

Patna High Court CR. MISC. No.28602 of 2019(2) dt.03-05-2019 2/2 nature as evident from the impugned order. Barring the one case which has been filed by the informant against the petitioners there is no other criminal case pending against the petitioners.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara in connection with Tarari P.S. Case No. 138 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
