The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code and section 27 of the Arms Act.

The allegation against the petitioner is of having fired on Rameshwar Ram resulting in his death.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 7.12.2020 passed in Cr. Misc. no.15687 of 2020 (Annexure-1). Inspite of the petitioner having remained in custody since 18.6.2019, there is no progress whatsoever in the case in the learned court below. Co-accused Pintu Nut has been enlarged on bail vide order dated 4.8.2021 passed in Cr. Misc.

Patna High Court CR. MISC. No.38762 of 2021(5) dt.24-11-2021 2/2 no.12060 of 2021.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the direct allegation against this petitioner of having fired resulting in death of Rameshwar Ram, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.

Learned trial court is directed to expedite the case/trial.
