The petitioner is in custody in connection with Kochaikote P.S. Case No. 59 of 2019 for the offences under sections 27b(ii), 37(b), 28 read with section 36/A/C of Drug and under section 27b(ii), 37(d), 28 read with section 36 A/C of Drug and Cosmetic Act, 1940 and Amendment Act, 2008 and Section 8C, 20C of N.D.P.S. Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 17.02.2019. He further submits that on search 11200 bottles of 100 ml. of Phensedyle Cough Linctus was seized but nothing

Patna High Court CR. MISC. No.27675 of 2019(2) dt.26-04-2019 2/2 was recovered from the conscious possession of the petitioner and he has no concern with the seized syrup. He further submits that petitioner is a assistant driver of the vehicle. Considering the fact that petitioner is a driver of the vehicle and he has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned 1st Additional Sessions Judge, Gopalganj in connection with in Tr. No. 04/2019 arising out of Kochaikote P.S. Case No. 59 of 2019.
