The petitioner apprehends his arrest in Narpatganj P.S. Case No. 258/2014, registered for the offences punishable under Sections 324, 379 and other sections of the Indian Penal Code. The informant Dulari Devi alleged that she had some verbal altercation with her sister-in-law (Gotni) Shugni Devi, but on the next day i.e., 11.07.2014 the petitioner came and threatened the informant of dire consequence on account of quarreling with Shugni Devi. The informant sent her husband to Mukhiaji for information, but the petitioner brutally assaulted her husband and thereafter, again came to her house assaulted the informant and other family members, threw conc. acid on them. The informant and her two children got burn injuries caused by acid.
Patna High Court Cr.Misc. No.46908 of 2016 (2) dt.15-12-2016 2/2 Learned counsel for the petitioner submits that there is no motive against the petitioner. Mother-in-law and other family members of the informant did not disclose the name of the petitioner. It is further submitted that the injury report shows that the victim was examined on 30.10.2014, although, the occurrence took place on 11.07.2014, but it appears from the F.I.R. and the injury report that informant made specific allegation that the petitioner assaulted the informant, her husband and children, threw conc. acid causing burn injuries to the informant and her two children. The informant and her two children were examined by the doctor on 11.07.2014 itself vide registration no. 4019, 4017, 4018, but the requisition sent on 30.10.2014, which does not create doubt about the injuries caused to the informant and family members.
Considering the facts aforesaid and nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
