The petitioners apprehend their arrest in Angarghat P.S. Case No. 58/2016, registered for the offences punishable under Sections 307, 379 and other Sections of the Indian Penal Code.

The informant alleged that Lalbabu Rai was urinating in front of his house. When the informant objected, all the accused persons assaulted his son and other family members. Learned counsel for the petitioners submits that there is a counter version being Angarghat P.S. Case No. 59/2016 in which it is alleged that the nephew of the informant was urinating

Patna High Court Cr.Misc. No.46721 of 2016 (2) dt.02-12-2016 2/2 on the hand pump and Dharmdeo Rai abused and assaulted Manjesh Kumar, nephew of the informant. Other accused persons also assaulted the informant and others. It is further submitted that the injuries found on the person of the informant and others are simple in nature. On account of petty dispute both side entered into scuffle and both sides got injuries.

Considering the facts aforesaid and the fact that the informant and others got simple injuries, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Dalsinghsarai, Samastipur in connection with Angarghat P.S. Case No. 58/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
