JUSTICE SANJAY PRIYA ORAL ORDER 17-01-2017 Heard learned counsel for the petitioners and the State.

The petitioners apprehend their arrest in Dulhin Bazar P.S. Case No. 107 of 2016 instituted for the offences under Sections 328, 302 and 201 of the Indian Penal Code. It is alleged by the informant that these petitioners with other accused persons killed her daughter Bharti Raj, aged about 10 years by forcibly administering poison to her. It has been submitted that both these petitioners are married Gotani of the informant. The same has been lodged due to family dispute and the husband of the informant has died. She had filed the case to give pressure to the in-laws.

There is no specific allegation against these petitioners. In the circumstances, prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Dulhin Bazar P.S. Case No. 107 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- each (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Danapur (Patna), subject to the conditions as laid down under Section 438(2) Cr.P.C.
