The petitioner seeks bail in a case registered under Sections 341, 323, 307, 354(a)/34 of the Indian Penal Code and Sections 8/12 of the POSCO Act.

Allegation is that the accused persons including the petitioner assaulted the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.07.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The matter relates to family dispute. The informant is the wife of the petitioner. There is no medical

Patna High Court CR. MISC. No.27137 of 2019(2) dt.25-04-2019 2/2 examination report in respect to offence under Section 307 of I.P.C. The allegations made in the F.I.R. are denied by the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge 1st, Patna-cum-Special Judge, POSCO, Patna in connection with Bihta P.S. case No.749 of 2018/ Special case No.132 of 2018.
