JUSTICE SANJAY PRIYA ORAL ORDER 18-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.

It is alleged that the petitioner assaulted the informant with lathi on the head causing injury to him. The learned Sessions Judge has mentioned in the impugned order that paragraph-36 of the case diary shows the opinion regarding the injury caused on the person of the informant and the viscera has been kept reserved for C.T. Scan, but no C.T. Scan report has been submitted.

Case diary has been received wherein it is mentioned in paragraph-36 that no C.T. Scan report and x-ray report is

Patna High Court Cr.Misc. No.43418 of 2016 (3) dt.18-01-2017 2/2 available. From perusal of the record, it appears that there is a land dispute between the parties.

Considering the aforesaid facts and circumstances of the case, let the petitioner in the event of surrender, named above, within six weeks from the date of receipt of this order, in connection with Karpi P.S. Case No. 42 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad, subject to the conditions as laid down under Section 438 (2) Cr.
