The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30 (a) and 37 (b) (c) of the Bihar Excise Act.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner. The petitioner having clean antecedent.
