JUSTICE ARUN KUMAR ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 341, 504, 354(B) and 379/34 of the Indian Penal Code.
The allegation, in brief, is that the petitioner entered into the house of the informant and started outraging her modesty. It is also alleged that he came into her house alongwith his son and wife and also committed theft.
It is submitted that earlier a case was lodged by the petitioner's wife and there is boundary dispute in between them and due to that, this false allegation was levelled and the petitioner has clean antecedent.

No.55263 of 2016 (4) dt.09-02-2017 2/2 Considering the aforesaid facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Dinesh Sharma @ Dinesh Kumar Sharma @ Baidya Charya, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Katihar Town (Sahayak) P.S. Case No. 691 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
