28-06-2018 Heard Sri Manish Kumar no. 2, learned counsel assisted by Sri Gajendra Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, having clean antecedent, which fact has been stated in paragraph - 3 of the petition, apprehending his arrest in Excise Case No. 305 of 2017 arising out of Korma P.S. Case No. 08 of 2015 registered for offence under Sections 272 & 273 of the Indian Penal Code and Section 47(A) of the Excise Act, has prayed for grant of bail in the event of his arrest or surrender, primarily on the ground that only on suspicion petitioner has been arrayed as accused. By way of referring to F.I.R., learned counsel for the petitioner has reiterated that save and except suspicion, there is

Considering the fact that petitioner is having clean antecedent as well as fact that only on suspicion he has been arrayed as accused, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Putul Ram be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. District & Sessions Judge, Sheikhpura in connection with Excise Case No. 305 of 2017, arising out of Korma P.S. Case No. 08 of 2015, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
