2. Petitioner seeks pre-arrest bail in connection with Marhowrah P.S.Case No.782 of 2023 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

3. As per the allegation made in the FIR, the deceased and the petitioner cooked fish and ate together and just next day, the deceased was found dead in the field. There is direct allegation against the petitioner.

4. Learned counsel appearing on behalf of the petitioner submitted that there is no eye witness to the occurrence and only with a view to extort money from the petitioner, the present case has been lodged.

5. Learned APP for the State has vehemently opposed

Patna High Court CR. MISC. No.32354 of 2024(3) dt.21-09-2024 2/2 the prayer for grant of pre-arrest bail to the petitioner.

6. Having considered the rival submissions made on behalf of the parties, as well as, considering the nature of allegation made in the FIR, I am not inclined to enlarge the petitioner on pre-arrest bail.

7. With the above observation/direction, the present bail application stands dismissed.
