This is an application for grant of anticipatory bail in connection with Sugauli P.S. Case No. 32 of 2021 registered for the offence punishable under Sections 406, 420 and 188 of the Indian Penal Code.

At the outset, the learned counsel for the petitioner submits that the petitioner would deposit the E-Pos machine before the SubDivisional Officer, Sadar Motihari within a period of four weeks from today and thereafter, surrender before the learned court below and avail the

However, it is further submitted that the learned court below be directed to consider the case of the petitioner for grant of bail sympathetically, especially considering the factum regarding deposit of the E-Pos machine with the concerned Sub-Divisional Officer.

Accordingly, the present petition stands disposed of as not pressed, however, with liberty to the petitioner to deposit E-Pos machine with the concerned Sub-Divisional Officer within a period of four weeks from today and surrender before the learned court below for the purposes of availing the privilege of regular bail. It is further directed that in case the petitioner deposits the E-Pos machine and surrenders before the Ld. Court below, his prayer for grant of regular bail shall be considered sympathetically.
