JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Bairiya P.S. Case No. 44 of 2017 registered for the offence punishable under sections 363, 366A of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case as the victim is a major lady and she was in love with this petitioner and she out of her free will is residing with this petitioner. The matter has been compromised between the parties as would be appearing from the compromise petition annexed as Annexure2. From the copy of the Adhar Card (Annexure-3), it appears that the date of birth of the victim lady is 01.09.1997 which establishes that she is a major lady. Petitioner is a man of clean antecedent.

No.54325 of 2017(2) dt.21-12-2017 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 44 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
