2. The present petition has been filed under Section 482 Cr.P.C. for quashing the order 12.06.2017 passed by the learned Special Judge Excise Act, Kaimur at Bhabhua in Excise Case No. 195 of 2017, arising out of Chand P.S. Case No. 53 of 2017 by which cognizance was taken against the petitioner under Section 120B/34 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act.

3. Learned counsel for the petitioner submits that this case has become infructuous, accordingly, the same may be disposed of.

4. Learned A.P.P. for the State has no objection to this prayer of the petitioner.
