JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 531 (C) of 2016, disclosing offence under Section498A of the Indian Penal Code. Allegation against the petitioner is of subjecting the complainant-wife to torture and harassment with respect to demand of dowry.

Submission of the learned counsel for the petitioner is that as a matter of fact, he is still ready to keep her with dignity and care, rather it is the opposite party no.2-wife, who is not interested to live with him, which will appear from the statement of the complainant on Solemn Affirmation during enquiry, which shows that she does not want to live with the petitioner, rather she is interested in divorce.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M., VIII, Bhojpur, Ara, in connection with Complaint Case No. 531 (C) of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
