JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Paroo P.S. Case No. 266 of 2015 registered under Sections 341, 323, 324, 441, 307, 354, 504 and 506/34 of the Indian Penal Code.

The accusation is that the petitioner and his son Suresh Rai armed with garasa and iron rod entered in the house of the informant Urmila Devi with intention to outrage her modesty unfolded her sari and started abusing. On raising alarm by the informant, Suresh Singh caused injury through garasa at the head of the informant. At that time, they also snatched cash Rs. 1000/- and gold chain.

Learned counsel appearing on behalf of the

Patna High Court Cr.Misc. No.44536 of 2016 (2) dt.27-10-2016 2/2 petitioner submits that in fact, informant is the wife of the younger brother of the petitioner and due to family dispute, hot talk were exchanged and scuffle took place, in which the petitioners also sustained injury regarding which Paroo P.S. Case No. 267 of 2015 is instituted. Moreover, only one lacerated injury of 'U' shape was found on the scalp of the informant and City Scan and 'X' Ray were advised, but that was not procured till disposal of the anticipatory bail on 29.08.2016 by which the prayer of the petitioner was rejected by the Court below.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M., 1st Class, Muzaffarpur in connection with Paroo P.S. Case No. 266 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
