This is 2nd attempt for grant of bail on behalf of petitioners in Sheyampur Bhatahan P.S. Case No. 11 of 2019 registered for the offence under Sections 363, 366(A), 120B, 504, 506/34 of the I.P.C. Earlier, the prayer for bail of petitioner was rejected, vide order dated 24-10-2019 passed in Cr.Misc. No. 41834 of 2019 (Annexure - 1 to the bail petition). On last occasion, vide order dated 27-11-2020, a report was called for from the learned trial court regarding stage of the trial, which has been received and kept at flag 'R'. From perusal of the same, it appears that in this case, charge has been

Patna High Court CR. MISC. No.28507 of 2020(3) dt.08-01-2021 2/2 framed on 16-11-2019 and the case is running at the stage of evidence.

It is submitted on behalf of petitioners that thrust of the allegation is against co-accused Raja Singh. So far as these petitioners are concerned, they have been made accused only due to the fact that they are father and brother respectively of co-accused Raja Singh, who is said to have fled away with the daughter of the informant. Petitioners are in custody since 25-04-2019.

Considering the aforesaid facts and circumstances as well as stage of the trial and period of custody, the bail application of petitioners is allowed.

Let the petitioners, above-named, be released on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Sheohar in connection with Bhataha P.S. Case No. 11 of 2019, corresponding to Sessions Trial No. 84 of 2019.
